One thing is troubling in the Privacy Policy:
"Access to your personal information will be limited to specific Pivotal employees. Specifically, Pivotal authorizes a limited set of people to act as "super admins" of the Service. While performing functions of customer support, site maintenance, research, debugging, or testing, these individuals may search and alter any information in the database, including but not limited to user information, project information, story information, and time records."
I love Tracker, but I fear that our Legal department might have an issue with Pivotal
'searching and altering" our information for anything BUT customer support without our explicit permission. Can you please explain/clarify this part of the policy (I REALLY want to use Tracker as opposed to Thoughtworks' Mingle) Thanks! -
Inappropriate?Hi Kevin, we're in the process of revising and clarifying the language in our privacy policy, but I'd like to assure you that we're absolutely committed to ensuring that our users' data is private.
Access to user and project information is strictly limited to a handful of trusted people here at Pivotal Labs, and it's only used for support purposes. For example, if a user reports a problem with one of their projects (for example, the project does not load in their browser), we will access that project in order to reproduce or diagnose that problem.
The only time that we may alter data is when a user explicitly requests it, for example to change the point scale of a project, or if we discover a data corruption issue that requires a correction procedure.

Inappropriate?Thanks for the speedy response, Dan. Unfortunately, Legal still won't approve our using Tracker due to lack of Terms of Use:
"We're generally okay with their privacy policy, which is what Dan seems to have reiterated below. But a privacy policy can't substitute for terms of use. The privacy policy is intended to describe how our information will be used by the company whereas a terms of use sets forth the actual license terms for using the site and who has responsibility when the other party doesn't meet or breaches its obligations - and that's where we have the issue. If we are placing Company proprietary information on a third party site and have no recourse if the information is breached, even if Pivotal tried really hard to ensure a secure system, then there is risk.
So, we would recommend not using the third party site until there are appropriate terms of use."

The end user license agreement for Tracker is available here:

It shown to all users when they first register for a Tracker account. We'll be updating the language in the agreement within the next few weeks, and we'll also add more prominent links to it so that it's more easily accessible.

Inappropriate?If we're talking about legal concerns, this is what bothers me (from the EULA):
"We provide the Services and Software for your personal use. You may not use the Services or Software to conduct business without a separate written contract with Pivotal."
IANAL, but I would think that "personal use" is not really what most of us are looking at. E.g., we (my employer) are in the process of creating a web service, and we will use subcontractors for part of the job. We wouldn't mind signing a contract with Pivotal, but I haven't found any pointers to this anywhere. The only mention of this limitation is in the EULA, and I don't find a hint of it in FAQ.
I don't want to come through as complaining about a free service, but I'd rather not use it in breach of the license. -
